THE PROSECUTOR OBJECTED TO ANY BOND REDUCTION.>>ALTHOUGH THIS DEFENDANT IS CHARGED WITH MURDER AND MURDER ONLY AT THIS TIME, ALONG WITH LEAVING THE SCENE OF AN ACCIDENT, AND THERE’S NO DUI ATTACHED TO IT, I CANNOT SAY FOR CERTAIN THAT WON’T COME AT A LATER DATE, WHICH MAKES THAT VEHICULAR HOMICIDE, ALCOHOL INVOLVED, RELEVANT. MARK: THE PROSECUTOR SAID CARAWAY HAS THREE PREVIOUS DUI CONVICTIONS, INCLUDING ONE IN 2013 WHERE HE LEFT THE SCENE.>>SO THERE’S A PATTERN, IT’S BEEN ONGOING. THERE’S ALSO A VERY REAL ISSUE OF, WHO WAS THE OPERATOR OF THE MOTOR VEHICLE? MARK: THE JUDGE WAS NOT CONVINCED.>>I DO BELIEVE THE FACT THAT SOMEONE HAS BEEN CONVICTED OF, NOW I KNOW, THREE PRIOR DUI’S THEIR PAST, AND ARE SOMEHOW ASSOCIATED WITH AN ALCOHOL-RELATED TRAGIC SITUATION WHERE SOMEONE LOSES THEIR LIFE, DEFINITELY GOES TO THE REASONABLY ANTICIPATED CONDUCT. MARK: THE JUDGE DID SAY SHE WOULD ALLOW CARAWAY TO POST PROPERTY AS BOND, BUT IF THAT’S THE CASE, HIS BOND GOES UP TO $200,000.
